Terms of Service

The agreement between you and Hatched Digital. Written clearly, because terms you can't understand aren't terms you genuinely agreed to.

The short version

We build honest software for small businesses. If you use our products, we ask that you use them responsibly. We'll treat you fairly, and we expect the same in return. Everything below is the detail behind that simple idea.

Who we are

Hatched Digital is a digital product studio based in New Zealand. When we say “Hatched Digital,” “we,” “us,” or “our,” we mean Hatched Digital and its products — including Nest, Senderkit, and any future tools built under the hatched.digital domain.

Using our services

By accessing or using any Hatched Digital product, you agree to these terms. If you're using our services on behalf of a business, you confirm you have the authority to bind that business to these terms.

You must be at least 16 years old to use our services. You're responsible for keeping your account credentials secure and for all activity that occurs under your account.

What you can expect from us

  • 1.Honest pricing — No hidden fees, no surprise charges, no bait-and-switch. The price you see is the price you pay.
  • 2.Reliable service — We build on modern cloud infrastructure and aim for high availability. When things go wrong (they sometimes do), we communicate openly and fix them quickly.
  • 3.Data protection — Your data is yours. We protect it with encryption, access controls, and the practices outlined in our Privacy Policy.
  • 4.Fair treatment — If we ever need to change our pricing, features, or these terms, we'll give you reasonable notice and an honest explanation.

What we expect from you

  • 1.Lawful use — Don't use our products for anything illegal, harmful, or deceptive.
  • 2.Respect for others — Don't abuse, harass, or interfere with other users or our systems.
  • 3.Accurate information — Provide truthful information when creating an account or making a purchase.
  • 4.Security — Keep your login credentials private and let us know immediately if you suspect unauthorised access.

Payments and billing

Some of our products are free. Some are paid. For paid products:

  • -Prices are displayed in your local currency where possible, and include all applicable taxes.
  • -Payments are processed securely through Stripe. We never store your full card details.
  • -Subscriptions renew automatically unless you cancel before the renewal date.
  • -We offer refunds on a case-by-case basis. If you're unhappy, talk to us first — we'd rather make it right than keep your money.

Intellectual property

Hatched Digital owns the design, code, branding, and content of our products. You own your data — anything you create, upload, or store within our products belongs to you.

We grant you a personal, non-transferable licence to use our products for their intended purpose. You may not copy, reverse-engineer, or redistribute our software.

Your content and data

You retain full ownership of everything you put into our products. We don't claim any rights over your content. We access your data only to provide the service, maintain security, or when you explicitly ask us to (like a support request).

If you delete your account, we delete your data. No hidden retention, no “we keep it for 7 years just in case.” When it's gone, it's gone.

Service availability

We work hard to keep our services available, but we can't guarantee 100% uptime. Outages happen — servers fail, updates require maintenance, and the internet is imperfect. We aim for high reliability and will always communicate transparently when something goes wrong.

We reserve the right to modify, suspend, or discontinue any product with reasonable notice. If we ever shut down a paid product, we'll give you ample time to export your data and will refund any unused prepaid period.

Account termination

You can close your account at any time. We may also suspend or terminate accounts that violate these terms — but we'll always explain why and give you a chance to resolve the issue first, unless the violation is severe (illegal activity, abuse, or security threats).

Limitation of liability

We build our products with care, but we provide them “as is.” To the fullest extent permitted by New Zealand law, Hatched Digital is not liable for indirect, incidental, or consequential damages arising from your use of our services. Our total liability is limited to the amount you've paid us in the 12 months preceding any claim.

This doesn't affect any rights you have under the New Zealand Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot be excluded by agreement.

Governing law

These terms are governed by the laws of New Zealand. Any disputes will be resolved in the courts of New Zealand. We'd prefer to resolve disagreements through honest conversation before involving lawyers — and we expect you would too.

Changes to these terms

We may update these terms from time to time. When we do, we'll update the date at the top of this page and notify you of significant changes via email. Continued use of our products after changes take effect constitutes acceptance of the updated terms.
